Welcome to KingdomX web hosting! We are very proud to call ourselves America’s free speech web host. This is the Acceptable Use Policy of KingdomX. If you violate our Acceptable Use Policy, there will be consequences. Those consequences may include:

Immediate termination of your account with NO REFUND.

A 24 to 72 hour request for you to remove your website to another host – at your expense. If you ask us to do the transfer, our normal fees will apply.

Financial implications, if your use of our services impede other clients in any way that has a demonstrable financial impact on them.

USING OUR SERVICES
KingdomX has been in business under the same name and same ownership since 1998.  KingdomX has always allowed political free speech that does not violate the laws of the United States of America.

UNDERSTANDING THE FIRST AMENDMENT
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

So, as you can see, your free speech rights are only guaranteed BY the government, FROM the government. No one else has any legal or moral obligation to allow your free speech. This is why other providers such as GoDaddy will not hesitate to remove your website without any notice. However, the constitution still affords rights to business owners to determine who we want as clients, and the right to determine who we do not wish to associate with, and that must be respected as well.

OTHER INFORMATION
We do not host foreign websites or websites owned by foreign companies, entities, organizations or persons. That is because we have no legal or civil jurisdiction over them if they were to violate our terms.

Wherever possible, we block certain forms of foreign traffic in an effort to protect the integrity of our servers. These blocks will always include the Russian Federation, China, and Ukraine – wherever possible. If your website is dependent on traffic from these countries (or any foreign countries), please reconsider use of our services.

If you choose a web hosting plan that is not reflective of your website and/or usage, we reserve the right to require that you upgrade your package (and pay any difference).

Your use of the services must be lawful; you may not use our services to contravene the laws of the United States. It is important that you consider your use of our services prior to accepting our AUP.

SPECIFIC PROHIBITED USES

SPAM AND MASS EMAILS – You must comply with the CAN-SPAM law, 15 U.S.C. §7701 et seq. You must also send email in a way that respects the stability of our network. If we determine that your use of email affects our network or our other customers, in a material, adverse manner, we may suspend your account until such time as you have agreed to modify your behavior. While your account is suspended, fees will continue to accrue – and no refunds or credits will be given. It is extremely unlikely under most circumstances, this would ever happen to your account – unless you are spamming. Spamming is not limited to sending mail from our servers, it also includes your use of other methods to send mass unsolicited emails that lead or link to your website hosted with KingdomX. Unless all your recipients specifically opted in to receive emails from you – it can be considered spam, whether or not you are trying to sell something.

COPYRIGHT VIOLATIONS – Use of our Services requires that you honor and respect U.S. copyright law. If you are not familiar with US copyright laws, it is your responsibility to familiarize yourself with those laws or consult an attorney. You may not use our Services to infringe anyone else’s copyright. You may not go to someone else’s website and copy their content in whole or in part. Do not steal photos from other websites and use them on any website hosted with us.

TRADEMARK INFRINGEMENTS – Use of our Services requires that you honor and respect U.S. trademark law. If you are not familiar with US trademark laws, it is your responsibility to familiarize yourself with those laws or consult an attorney. You may not use our Services to infringe anyone else’s trademark rights. Trademark infringement includes, but is not limited to, displaying another entity’s trademark on your website, using trademarked words in meta tags and other text-based aspects of your website, and selling or distributing goods that you do not have a right to sell.

For the avoidance of doubt, it is a violation of this AUP to use our Services to sell “grey market” goods. We will take action on a notice of trademark infringement that includes the following: the name of the owner of the trademark; the U.S. registration number of the trademark; the website on which the trademark infringement is alleged to occur, and each URL on which an instance of infringement is present; the mailing and email address and a working telephone number of the entity or person providing notice of infringement; and a statement that the use of the trademark in this manner is unauthorized and infringing.

PROHIBITED CONTENT – KingdomX is not an “anything goes” hosting provider. You may not use our Services to distribute, advertise, disseminate, link to content that contains, describes, or refers to child pornography, bestiality, child erotica, gambling, nude or sexually explicit photos of ANYONE without their consent (usually in the form of revenge porn), or any other content prohibited by U.S. law.

Doxxing – We absolutely, positively do not allow websites, or website content (including forum posts and/or comments) that engage in doxxing or the posting of any individual’s private and/or personal information including, but not limited to; addresses (exact or otherwise), business names (in an attempt to harm someone’s business), phone numbers, family member names, vehicle license plate numbers (or imagery thereof), etc. Yes, this applies to politicians as well. Many states (including California) actually prohibit violating the privacy of elected officials. Just don’t do it.

Threats of Murder or Violence – KingdomX prohibits the use of our services to engage in or call for (directly or indirectly) death threats or physical violence of anyone, or any group, including elected officials. To be clear, it is one thing to say “I hate my president” or “I wish XYZ were dead”, that is not prohibited, but to make any statements that imply or encourage the murder or physical harm of anyone is not acceptable. In most jurisdictions it violates state and federal laws. You are REQUIRED to visibly incorporate this into your website terms if your website allows any type of public posting. Failure to do so will result in the suspension and/or termination of your web hosting account – without notice and without refund or credit.

We will take action on a notice of prohibited content that includes the following: the name of the website on which the prohibited content is alleged to reside, and each URL on which an instance of the content is present; the mailing and email address and a working telephone number of the entity or person providing the notice; and the date on which the prohibited content was observed.

Internet Relay Chat (IRC) – No connections to IRC or IRC-like servers or hosts may be made using our Services. IRC related programs, including, but not limited to, clients, bots, and servers, may not be run using our Services.

Monitoring – You may not engage in probes, port-scans, sweeps or spoofing of systems. We will report this activity to the appropriate law enforcement entity.

ACCURACY/CONFIDENTIALITY – Providing us with accurate information not only makes it easier for us to contact you, but it also speeds our response to any complaints or issues you present to us. It is your obligation to provide accurate, updated information to us.

COOPERATION WITH LAW ENFORCEMENT – We will comply with legitimate and constitutional requests from law enforcement and other governmental entities for information. When possible, we will give you notice of these requests. However, in most cases, we are prohibited from giving you notice. Requests for information from law enforcement entities must contain the following: The name, address and email address of the individual to whom the information will be sent; a copy of the warrant or subpoena that has been signed by the relevant judicial entity; if the request is an administrative request, the request must cite the law pursuant to which the request is made, and must be physically signed by the requestor; and a date by which a response is requested, which must be at least ten days from the date on which the request is received by us. We are not another Liberty Safe who hands over private information just because a law enforcement agency asks for it.

ALL OTHER REQUESTS –  All other requests, or notices that the services are being used in violation of this AUP or law, must contain the following, and are not confidential: the name, address, email address, and a working telephone number of the individual making the allegation; the website against which the allegation is made, and all URLs supporting the allegation; and the date on which the violation was observed. We do not automatically honor takedown requests unless there is evidentiary support of the allegations being made, and positive identification of the person making them.

SECURITY – The internet is no more or less secure than any other method of communication. You are solely responsible for ensuring that your data is secure, that confidential information remains confidential, and that you do not expose your business to risks you are not prepared to assume. We reserve the right to take immediate action to suspend or terminate your account if, in our sole and exclusive discretion, you or a customer or end user of yours is engaging in activities that jeopardize our security, the security of other customers, or the security of the Internet in general. You may not be provided with advance notice that we are taking such action.

Trashing KingdomX, Our Agents, Or Our Employees – We are not going to take that very lightly. We are here to help you. Don’t bite the hand that feeds you because you may not find another hand!

Incoming Website Transfers – When you transfer your existing WordPress website to our servers, we will run a security check on it prior to the transfer to make sure there are no viruses or malware. All your apps, themes and plugins MUST be updated prior to the transfer. You should also consider deleting any email accounts that you are not using, as email is the number one resource user on our servers. Even unused email accounts are subject to receiving a lot of spam and bot hits, which take up our bandwidth and force us to raise prices. It is to your benefit to delete unused files, images, videos, emails, etc from your account before the transfer and before you make a backup copy.

OTHER REQUIREMENTS AND EXPECTATIONS
Your failure to keep your WordPress website themes, apps and plug-ins updated can create a security risk for everyone on our server. If KingdomX has designed your website, we include updates for the first year. If you (or someone else) has designed your website, you must run your updates at least once per week.

If your website hosts an open blog, forum, etc., where you and others make posts that are public or that are open to all members, you are required to adopt our terms into your terms to ensure that your users do not violate our terms.
We expect all our clients to join and frequently follow our social media pages for important and critical information such as server outages, maintenance outages, etc. Social media is the method we use for such notices.
